RE: The tariff classification of an air filter from China

Dear Mr. VanPelt:

In your letter dated March 4, 2013, you requested a tariff classification ruling.

The subject merchandise, based on the submitted information, is an air filter, identified as the “Plastic Vent Cover” (part number 0A-1446-0122), which measures approximately 7 inches high by 7 inches wide by 2 ½ inches deep. The vent cover comprises three levels of protection against the entry of objects, dust and moisture, including two-directional louver blades and a nonwoven synthetic fiber filter housed in a plastic cover. After importation, the vent cover will be attached to a separately imported exhaust fan, situated inside and mounted to the rear of the light-emitting diode (LED) video and message display.

The internal louver blade is designed to cause a “V-shaped” airflow pattern that allows air to pass unhindered, while trapping water and dust particles that impact it at any angle. Moreover, although the fiber-based filter media will absorb moisture, it has such draining properties that prevent the fan from pulling water into the display. In conjunction with this feature, the bottom surface of the vent panel is so designed to allow the water, drained from the filter, to drain back out the front of the vent.

The applicable subheading for this air filter will be 8421.39.8015, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Centrifuges, including centrifugal dryers; filtering or purifying machinery and apparatus, for liquids or gases; parts thereof: Filtering or purifying machinery and apparatus for gases: Other: Other: Dust collection and air purification equipment: Other. The rate of duty will be Free.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Denise Faingar at (646) 733-3010.

Sincerely,
